Terms of Business

Accepting our Terms of Business

By asking us to quote for, arrange or handle your insurances, you are providing your informed agreement to these Terms of Business. We draw your particular attention to the section headed 'Use of personal data', and specifically the paragraph explaining how 'sensitive personal data' will be used.

This Terms of Business statement relates only to the services provided under the brand "QuoteMyShop.com".

The Financial Services Authority

QuoteMyShop.com is a trading style of Brian Thornhill & Son (Insurance Brokers) which is authorised and regulated by the Financial Services Authority (FSA). Our FSA Register number is 306565. Our permitted business is advising, arranging, dealing as agent and assisting in the administration and performance of general insurance contracts. Our Service

Our role is to advise you and make a suitable recommendation after we have assessed your needs. In situations where we are able to arrange insurance for you but do not offer advice, we shall confirm the position to you in writing. We will not in any circumstances act as an insurer nor guarantee or warrant the solvency of any insurer.
We only offer shop and office insurance products from AXA Insurance (UK) Plc.

Complaints and Compensation

We aim to provide you with a high level of customer service at all times, but if you are not satisfied, contact us: in writing to the above address or by telephone on 01924 499182. Your complaint will be acknowledged within 5 working days of receipt. We will try resolving your complaint quickly, if however, we cannot then we shall write to you within 20 days to explain the situation. If you are still not satisfied, you may refer the matter to the Financial Ombudsman Service (except in the case of commercial customers with a group annual turnover of £1 million or more, charity with an annual income of £1 million or more, or trustees of a trust with a net asset value of £1 million or more). We are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 100% of the first £2,000 and 90% of the remainder of the claim, without any upper limit. For compulsory classes of insurance, (such as Employers Liability), insurance advising and arranging is covered for 100% of the claim, without any upper limit. Payment for our Services

We normally receive commission from insurers or product providers for the placing of your insurance policies. We also charge you for handling your insurances as follows:- Mid Term Amendment or Cancellation under £100.00, incurs a £15.00 charge, over £100 incurs £25.00 charge. You will receive a quotation which will tell you the total price to be paid, and which identifies any fees, taxes and charges separately from the premium, before your insurance arrangements are concluded. In the event that your policy is cancelled, after the 14 day cooling-off-period, there will usually be no return of fees. A payment will be required as soon as cover commences. This can be by cash, cheque, debit card,credit card, BACS (with prior agreement) or direct debit. Details of the instalment schemes will be discussed prior to the conclusion of the insurance contract, including any instalment or direct debit interest charges. You should not stop your monthly payments without first speaking to us as default could result in your policy being cancelled and leave you still liable for the outstanding balance. Handling Money

Our financial arrangement with AXA Insurance (UK) Plc is on a 'Risk Transfer' basis. This means that we act as agents of the insurer in collecting premiums and handling refunds due to clients. In these circumstances such monies are deemed to be held by the insurer with which your insurance is arranged. For the avoidance of doubt, there is a separate Terms of Business statement for any other policies with Brian Thornhill & Son.

Ending Your Relationship with Us

Subject to your immediate settlement of any outstanding premiums and fees, you may instruct us to stop acting for you and we will not impose a penalty. Your instructions must be given in writing and will take effect from the date of receipt. In circumstances where we feel we cannot continue providing services to you, we will give you a minimum of 7 days notice. Unless otherwise agreed in writing, if our relationship ends, any transactions previously initiated will be completed according to these Terms of Business. You will be liable to pay for any transactions concluded prior to the end of our relationship and we will be entitled to retain commission received for conducting these transactions, together with all fees charged by us for services provided.

Cancellation of Insurance

If you intend to cancel your policy for whatever reason, then we would ask that you telephone us beforehand in order to discuss it. This is especially important if you are paying by instalments or by direct debit.

 

Our Rights

We shall not be bound to accept any renewal of the policy and may at any time give 21 days notice of cancellation by recorded delivery to your last known address. Thereupon you shall be entitled to the return of a proportionate part of the premium paid in respect of the unexpired term of the policy provided that there have been

  • no claims made under the policy for which we have made payment
  • no claims made under the policy which are still under consideration
  • no incidents likely to give rise to a claim but are yet to be reported to us

during the current period of insurance this termination will be without prejudice to any rights or claims of the insured or the company prior to the expiration of such notice

If a claim has been submitted or there has been any incident likely to give rise to a claim during the current period of insurance no refund for the unexpired portion of the premium will be given.

 

Your Rights

You may cancel this policy during the 14 days after the contract has been concluded by giving notice to QuoteMyShop.com at the address shown at the top of this page or to the AXA Insurance address shown on your policy schedule

Provided that there have been

  • no claims made under the policy for which we have made a payment
  • no claims made under the policy which are still under consideration
  • no incidents likely to give rise to a claim but are yet to be reported to us

during this 14 day period of insurance we will give a refund for the proportionate part of the premium paid in respect of the unexpired term of the policy

If a claim has been submitted or there has been any incident likely to give rise to a claim during the current period of insurance no refund for the unexpired portion of the premium will be given.

Conflict of Interests

Occasions can arise where we or one of our associated companies, clients or product providers will have a potential conflict of interest with business being transacted for you. If this happens and we become aware that a potential conflict exists, we will write to you and obtain your consent before we carry out your instructions, and detail the steps we will take to ensure fair treatment.

Your Responsibilities

You are responsible for providing the complete and accurate information, which insurers require in connection with any proposal for insurance cover. This is particularly important before taking out a policy and at renewal, but is also applies throughout the life of a policy. If you fail to disclose information, or misrepresent any fact which may influence the insurer's decision to accept the risk or the terms offered, this could invalidate the policy and mean that claims may not be paid. You must check all details on any Statement of Facts and pay particular attention to any declaration contained therein. You should read all insurance documents issued to you and ensure that you are aware of the cover, limits and other terms that apply. Particular attention should be paid to any warranties and conditions as failure to comply with them could invalidate your policy. You should inform us immediately of any changes in circumstances that may affect the services provided by us or the cover provided by your policy. If you are unsure about any matter, please contact us for guidance.

Use of Personal Data

We will process any personal information we obtain in the course of providing our services to you in accordance with the Data Protection Act 1998. In administering your insurances it will be necessary for us to pass such information to insurers and other product or service providers which may also provide us with business compliance support. We may also disclose details to relevant parties, as necessary, to comply with regulatory or legal requirements. We may contact you or pass your details to other companies associated with us in order to promote products or services which may be of interest to you. We will not otherwise use or disclose the personal information we hold without your consent. Some of the details you may be asked to give us, such as information about offences or medical conditions, are defined by the Act as sensitive personal data. By giving us such information you signify your consent to it being processed by us in arranging and administering your insurances. Subject to certain exceptions, you will be entitled to have access to your personal and sensitive personal data for which you may be charged a fee of £10. If at any time you wish us or any company associated with us to cease processing any of the personal data or sensitive personal data we hold, or to cease contacting you about products and services, please write to Brian Thornhill & Son at the above address.

 

Insurers pass information to the Claims and Underwriting Exchange Register run by Insurance Database Services Ltd. The aim is to help us check the information provided and also to prevent fraudulent claims. When we deal with your request for insurance we may search the register. When you tell us about an incident which may or may not give rise to a claim we will pass information relating to it to the registers. You can ask us for information about this. You should show this paragraph to anyone who has an interest in property insured under the policy.

Claims Handling Arrangements

You should take note of the required procedures in the event of a claim, which will be explained in the policy documentation. Generally, insurers require immediate notification of a claim or circumstances which might lead to a claim. We will employ due care and skill if we act on your behalf in respect of a claim.
